Terms and Conditions
Draft, to be checked by a lawyer. Text in [square brackets] are my details, which I must fill in before I take any payments.
1. Who you are dealing with
ZYR Assistant is made and offered by me, [your full legal name], an individual, [full postal address], India, under the name “ZYR AI”. ZYR AI is not a company or any other kind of legal entity. In these terms “I”, “me” and “ZYR AI” mean me, and “you” means the person using ZYR Assistant
These terms are an agreement between you and me. They cover:
- the ZYR Assistant software for Windows;
- the ZYR Assistant Mobile app for Android;
- your ZYR Assistant account;
- the ZYR Assistant Relay;
- my website.
In these terms, “the app” means the Windows software and the Android app together. By creating an account, or by installing or using the app, you accept these terms. If you don't accept them, don't use ZYR Assistant Please read them together with the Privacy Policy and the Subscription, Cancellation and Refund Policy.
2. Who can use it
You must be at least 18 years old and able to make a contract under Indian law. If you use ZYR Assistant for your work, you confirm that you are allowed to accept these terms for it. ZYR Assistant is offered to people in India.
3. Your account and activation key
- You need a ZYR Assistant account, which you create on my website with your email address. A one-time code checks that the address is yours. Sign-in is provided by Clerk, the account service I use.
- One account is for one person. Use an email address that you can read, keep your sign-in to yourself, and tell me at zyr.agent@proton.me if you think someone else used your account.
- Don't create accounts with bots, scripts or false details, don't create many accounts, and don't share, sell or transfer an account. I may suspend or delete accounts that do.
- Activation key. The Windows app turns on with the activation key on your dashboard. It is for your own PCs only: don't share, publish or sell it. You can cancel a key on your dashboard, and I may cancel a key that is shared or misused. A PC with a cancelled key stops at its next daily check. A key also ends when your plan ends.
- You can delete your account at any time, in Account settings on your dashboard.
4. What you get
You get a licence to use the software, with the features of your plan, while your account is in good standing. Paid plans will start once checkout opens (see the Subscription Policy).
ZYR Assistant works with AI, speech and coding services run by other companies: Google, NVIDIA, OpenRouter, Groq, Microsoft, ElevenLabs, Anthropic, OpenAI and others. Those services are not part of what I provide. They use your own keys and accounts, and they have their own limits, prices, outages and terms. I don't promise any amount of AI answers, any particular speed, or that any of those services will keep working or stay free.
5. Your licence
I give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not:
- copy, sell, rent or share the app or your activation key;
- remove ownership notices;
- take the app apart to get around its activation or its signed updates, except where the law allows it.
The app and its name, look and code belong to me. Open-source parts keep their own licences.
6. The app can act on your PC, and your phone can control it
- On your PC. Some features let the assistant move the mouse, type, open and close programs and files, and run commands, based on what you say and on what the AI model decides. You are responsible for what you ask it to do, and for checking its work. Keep “Ask before running system commands” on if you want to confirm first, and press Esc to stop it at any time.
- From your phone. When you pair a phone, it can:
- send requests to your PC;
- use the Remote: touchpad, keyboard, power, apps, windows, files, routines and closing apps;
- send files to your PC;
- see your PC's screen while you watch it.
- Coding agents read and change files in the project folders you allow, and can run commands there. They work on a copy or after a snapshot, so you can keep or undo their changes, and nothing is pushed or published. Review their changes before you keep them.
- Don't use ZYR Assistant for anything where a mistake could cause injury, loss of life or serious harm.
7. AI answers can be wrong
AI models make mistakes, invent facts and misread screens. Answers are not professional advice, whether medical, legal, financial or any other kind. Check anything important yourself.
8. Your content
What you say, type, show on screen and keep in your files is yours. The app sends parts of it to the services described in the Privacy Policy when you use a feature that needs them. You decide what you are willing to send. Don't use the app to process information that you have no right to share.
9. Acceptable use
Don't use ZYR Assistant to:
- break the law;
- harm, harass or deceive anyone;
- access accounts, devices or data that you are not allowed to access, including another person's PC or phone;
- spread malware;
- overload or attack the relay or any other service;
- break the terms of the services you connect to it.
You are responsible for your API keys and for any charges on your accounts with those services.
10. Price and payment
Checkout isn't open yet. Prices, billing, renewal, cancellation and refunds are in the Subscription, Cancellation and Refund Policy, which is part of these terms. How you get access is in the Shipping and Delivery Policy.
11. Updates and changes
The app checks for and installs signed updates; you can turn this off in Settings. I may change features over time. If I remove a main feature of a paid plan in a way that makes it clearly worse, you can cancel and ask for a refund of the unused part of the period you paid for.
12. Suspension and ending
You can stop using ZYR Assistant and delete your account at any time. I may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. If I end a paid plan for any other reason, I will refund the unused part of the period you paid for. Parts of these terms that by their nature should continue, such as ownership, liability and governing law, continue after your access ends.
13. No guarantees beyond the law
I work to make ZYR Assistant useful and reliable, but software and online services are never perfect. As far as the law allows, it is provided “as is”, and I don't promise that it will be error-free, uninterrupted or suitable for your particular purpose. Nothing in these terms takes away rights you have under the Consumer Protection Act, 2019, or under any other law that can't be waived.
14. Liability
As far as the law allows, I am not liable for:
- indirect or consequential loss, lost profits or lost data;
- anything caused by services I don't run, by your devices or by your network;
- actions that you, or your paired phone, asked the app to take.
My total liability for any claim is limited to the amount you paid me in the 12 months before the claim (nothing, while checkout isn't open). This doesn't limit liability that the law doesn't allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence.
15. Changes to these terms
I may update these terms. For changes that matter, I will tell you in the app, on my website or by email at least 30 days before they apply to you. If you don't agree, you can stop using ZYR Assistant before then, and you can ask for a refund of any unused prepaid time.
16. Law, disputes and complaints
These terms are governed by the laws of India. Please contact me first, at zyr.agent@proton.me. I will reply within 48 hours and aim to resolve the matter within one month. If the matter can't be settled that way, the courts at [your city, state] have jurisdiction. Nothing here stops you from going to a Consumer Commission, or to any other forum you are entitled to use as a consumer. You can also call the National Consumer Helpline on 1915.
